Application of the General Terms and Conditions of Sale
In the absence of any specific provisions in these terms and conditions agreed in writing between the parties, orders shall automatically be subject to the general terms and conditions of sale set out below in electronic form, irrespective of any clauses that may appear in the purchaser’s documents. Placing an order in this manner implies the purchaser’s full and unreserved acceptance of these general terms and conditions of sale, to the exclusion of all other documents.
Jurisdiction
In the event of any disputes arising from the application of these general terms and conditions of sale, the purchaser and VALVICHANVRE undertake to reach an amicable resolution. Should, however, no agreement be reached, the following provisions shall apply:
- For a buyer who has placed an order from France: any disputes arising in connection with the performance, termination or interpretation of the contract shall be governed by French law. The competent court shall then be either the place where the defendant is domiciled or the place of actual delivery of the customer’s order.
- For a buyer who has placed an order from abroad: any disputes arising in connection with the performance, termination or interpretation of the contract shall be subject to the jurisdiction of the competent courts in accordance with the directives and regulations of the European Union.
Order
We take great care with the information provided for each product; however, VALVICHANVRE cannot be held liable for any unintentional errors in the information published on this website. All orders are binding and final. However, a correction request may be sent to VALVICHANVRE within 12 hours of placing the order. After this time, no changes can be made, as the order will already be in the process of being dispatched.
Products
The photographs featured on this website are the exclusive property of VALVICHANVRE. They may not be used or reproduced without prior permission. Products are available whilst stocks last and are dispatched on a first-come, first-served basis. In the event of a product being out of stock, VALVICHANVRE will offer an equivalent product (in terms of price and/or value); the purchaser is free to refuse this offer, in which case the sale of that product will be cancelled and the purchaser will be entitled to the refund terms set out in the section ‘Right of withdrawal’.
In the event of a bottle of wine having a cork taint, it will not be possible to replace the bottle without first receiving the cork from the affected bottle.
The price
The prices of the products shown are in euros, inclusive of VAT but excluding delivery charges (subject to typographical and display errors).
Products are sold at the prices listed on Valvichanvre.fr on the date of the order; the invoice, which can be downloaded from our website, will therefore be issued at the price in force at the time the order is placed.
In accordance with Article R.132-1 of the Consumer Code, VALVICHANVRE is entitled to unilaterally amend the terms of the contract relating to its duration, the characteristics or the price of the goods to be delivered.
Payment must be made in full as soon as your order is placed on our website.
Payment terms
Payment for an order can be made by cheque made payable to VALVICHANVRE, by bank transfer or by credit/debit card in euros (EUR €) via the secure Ingenico system, which acts as the gateway between the customer’s bank and our bank (La Banque Populaire). The customer’s account is debited in the currency of their country, based on the exchange rate applied by their bank.
We will dispatch your order as soon as we receive payment.
Retention of title
VALVICHANVRE retains ownership of all goods sold until full and actual payment has been made, in accordance with the terms of Law No. 80-336 of 1 May 1980 on retention of title.
Delivery
We do our best to keep our delivery times as short as possible. Delivery times vary depending on the type of postage and the delivery address.
Purchased products will be delivered within an average of two (2) to six (6) working days from the date the order is finally confirmed (receipt of full payment for the order or bank authorisation for an online payment). Products ordered as part of the same order will be delivered in a single consignment. Consequently, if the order includes specific products with a particular delivery time, as stated on the product page, the longest delivery time will be used as the reference for the order’s delivery date.
VALVICHANVRE undertakes to deliver within a maximum of thirty (30) days. If delivery cannot be guaranteed within this timeframe, the purchaser will be notified as soon as possible and will have the option to cancel their order. They will be entitled to the refund terms set out in the section ‘Right of withdrawal’.
We cannot be held responsible for a delivery address provided incorrectly by the buyer. Any costs incurred in resending the goods will then be borne by the buyer. Post office boxes will not be accepted for deliveries.
VALVICHANVRE will not cover any delivery charges arising from changes to the delivery address after an order has been dispatched; these will be invoiced directly to and borne by the customer who requested the change.
The only circumstances in which VALVICHANVRE undertakes to cover the cost of return postage are:
- in the event of a delivery that does not match the order
- for the return of an order following damage to the goods during transit, but only and exclusively where the terms of use set out in the section ‘Transport and Terms of Use’ have been complied with.
Transport and standard provisions
The goods ordered are transported at VALVICHANVRE’s own risk.
The risk of loss or damage to the goods shall pass to the customer once the customer or their representative has signed the delivery note. It is therefore important to check the contents and condition of the parcel at the time of delivery and, where necessary, to raise any objections as set out below.
Once the delivery note has been signed, VALVICHANVRE cannot be held liable if the standard terms and conditions have not been observed, namely: ‘The carrier shall only be liable if specific and comprehensive reservations have been made in writing on the copy of the consignment note presented by the delivery driver, in order to obtain a discharge from the consignee, and confirmed to the carrier specifically named on the consignment note, within three days of receipt, by registered letter”.
Right of withdrawal
In accordance with the Consumer Code, the purchaser has a period of 14 (fourteen) clear days from the date of delivery of their order to return the goods at their own expense, provided that the item has not been used, is in its original packaging and is accompanied by the delivery note. In return, the buyer will receive a refund of the full amount paid (i.e. a refund of the purchase price of the goods and the initial delivery charges) within a maximum of 30 (thirty) days, or a credit note.
Protection of minors
In accordance with the provisions of Article L3342-1 of the Public Health Code, as amended by Law No. 2009-879 of 21 July 2009, the sale of alcohol to minors under the age of eighteen (18) is prohibited. Consequently, by placing an order on our website and ticking the relevant box, you confirm that you are at least the legal age required on the date of the order.
Privacy
In accordance with the provisions of the French Data Protection Act of 6 January 1978, you have the right to access, amend, correct and delete any personal data concerning you that is held by VALVICHANVRE.
VALVICHANVRE guarantees that this information will be used strictly for internal purposes. Your contact details will not be shared with partners or service providers without your explicit consent.
